Post-Traumatic Stress Disorder

Post-traumatic Stress Disorder (or PTSD) is an anxiety disorder that may develop after someone has experienced or witnessed a traumatic event, such as exposure to actual or threatened death, serious injury, or sexual assault. Those involved in motor vehicle accidents, pedestrian or bicycle accidents, and slip-and-fall accidents, often suffer from Post-Traumatic Stress Disorder or other recognized psychological injuries as well.

According to the Diagnostic and Statistical Manual of Mental Disorders*, an individual with PTSD will often suffer significant impairment in their social interactions, capacity to work, or other important areas of functioning. Individuals with PTSD often experience feelings of stress, panic, anxiety and may feel frightened even when there is no immediate danger. Some of the most common symptoms of Post-Traumatic Stress Disorder are:

  • Re-experiencing Symptoms; This may include flashbacks, nightmares, and frightening thoughts.
  • Avoidance Symptoms; This may include avoiding places and events that revive memories of the traumatic event, feeling emotionally numb, losing interest in daily activities, and memory problems.
  • Hyperarousal Symptoms; This may include anxiety, insomnia, or anger management problems.

PTSD Insurance Claims

Victims of personal injury incidents usually suffer from physical injuries, which can range from less serious injuries like soft tissue damage to catastrophic injuries such as spinal cord injuries. However, sometimes psychological injuries can affect survivors of motor vehicle accidents or other events as significantly as their physical injuries do. A recent study reported that more than 22% of the victims of serious car accidents develop PTSD symptoms. (what study? So we can footnote it?)

Ontario’s Insurance Act stipulates that motor vehicle accident victims must prove that their psychological injury constitutes a permanent and serious impairment of one or more important functions in order to be entitled to damages. Sokoloff Lawyers can help you to assess and file your claim. Coping with a psychological injury can be difficult, and obtaining financial compensation can allow you to access the kind of help that can make your life easier. You may be eligible for various types of insurance benefits, and you may also be entitled to take legal action against an at-fault party. Our lawyers are tough negotiators on your behalf, and are formidable foes in the courtroom. Our firm requires no up-front fees; we will work on a contingency basis, which means that we don’t get paid until you get paid. We offer services in English, French, and a variety of other languages.
